Glossary:
WE/OUR/US – refers to 4 Ballroom Co-op – 4 Ballroom Co-op.com – 4 Ballroom Co-op marketplace, 4 Ballroom Co-op educatory services – marketplace service
YOU – refers to any seller, buyer or visitor that uses this site.
SELLER refers to any person that has a store listed on the site and has items available for sale.
BUYER – refers to any person that makes a purchase from any store listed on this site.
Plain English version = everyone play fair and no one gets detention.. 🙂
WHAT YOU NEED TO BECOME A SELLER
1- Products to sell (can be physical or downloadable)
1a – If your items are not yet saleable items we also offer a service to assist.
2- Online access to upload those products and information to your store
3- A paypal account for your payments when someone purchases your items You can get one here.
4- Educators who wish to sell items are required to become store owners and pay an owner fee that allows YOU use of our technology to provide a platform for the sale, tracking & promotion of items online.
WHAT CAN I SELL
a- Educators may sell any item relating to Ballroom dance that is fit for purpose.
b- Saleable items may be made available for download or for physical shipping.
c- Sellers may only sell items that have been uploaded into our service from their own 4 Ballroom Co-op marketplace site.
d- By uploading any item for sale, YOU represent and warrant to prospective Buyers that YOU have the right and ability to sell and to ship that item, that the listing is accurate, current, complete and is not misleading or otherwise deceptive. YOU further represent and warrant that the content is original to YOU, and that use of the same will not infringe any right – including, but not limited to the copyright or trademark right – of any third party.
PRICING:
a- Sellers are solely responsible for determining the prices for the sale of their products and items listed for sale through this site. (consider the service % and paypal fee) ( More info on the inside)
b- Sellers are obligated to sell their Content at the prices listed on the marketplace service at time of purchase by buyer.
** As an added protection for YOU, WE can stop track and follow piracy and illegal sharing of YOUR products
c- Sellers agree to provide incentive to Ballroom Co-op members available for offer at all times while operating a live store.
FEES:
4 Ballroom Co-op marketplace services ongoing fees are a percentage of each sale (so you only pay when someone buys from you)
There are 3 levels of store owner
Current yearly fees are – $10 for TRY ME – $60 for PRO and $75 for PREMIUM
Percentage of each sale regardless of level = 16% of each item
note: there will also be a Paypal item charge paid directly to Paypal through your account and is not controlled or seen by us.
WHEN ARE FEES DUE AND PAYABLE:
Store owner fees are due on a recurring basis 12 monthly ie whatever date YOU purchase the fee will be deducted on that day each year..
Percentage of each sale – happens immediately – automatically deducted with each purchase..
WHEN WILL I BE PAID:
for purchases made from my store – Immediately, we do not hold YOUR income, every transaction happens in real time..
WHAT HAPPENS WITH REFUNDS:
YOU are responsible for any refund issues or queries that may arise from purchases made in your store- see REFUND policy…
REFUND POLICY
NB: Individual Store owners handle their individual refunds
In relation to digital products be they printables or downloadable, it is not our policy to refund.
However a refund will be processed if
a- there is a legitimate issue with a file or product that cannot be rectified in a timely manner.(within 72 hours)
b- Duplicate purchases have been made (occasionally an order can go through the entire process without YOU noticing YOU just purchased a few of something that YOU only wanted one of NB: this is separate to actually purchasing a number of items to use between a number of educators.. ie each item purchased is for use by one only individual – see TRANSFER OF TITLE)
PROMOTION:
a- 4 Ballroom Co-op marketplace services will provide a wide and varied range of marketing and promotional procedures and offers, all of which are available to any educator that has an operating store via their store admin area.
b- These promotions, affiliate offers etc are made available as a whole and encompass all buyers and prospective buyers via an opt in platform.
c- Store owners may elect to purchase promotional space or offers at any time they are made available to you via your store admin area.
d- Store owners agree to provide an incentive item or items for 4Ballroom Co-op members available at all times.
e- Individual promotion or soliciting of any kind to any buyers is prohibited under our terms (see under SELLERS – BUYER INFORMATION) and sellers who are reported for doing such will have accounts suspended without restitution.
LICENSE GRANTS BY SELLERS
When YOU submit or upload content on or through the Service, you retain ownership of any copyright you claim to YOUR submitted content. However, by making YOUR content available through the Service YOU automatically grant 4 Ballroom Co-op marketplace services a royalty-free, perpetual, irrevocable (except as expressly set forth in this Agreement), non-exclusive, worldwide, sub licensable right to exercise any copyright, trademark rights publicity rights, and/or database rights you have in the content, in any media now known or later developed, solely as reasonably necessary to make the content available through the Service.
If YOU choose to cancel YOUR membership and leave the service, and/or have removed your content from the service, this license will be deemed revoked at the time that you cancel your membership and/or remove all such content. However 4 Ballroom Co-op marketplace license to make educational content you have sold prior to cancellation of your membership and/or removal of such content available to members who have purchased such material prior to cancellation of YOUR membership and/or removal of such content shall survive cancellation of YOUR membership and/or removal of such content.
TRANSFER OF TITLE
4 Ballroom Co-op marketplace services does not transfer legal title or ownership of items from the Educators, Publishers or Sellers to the Buyer.
Unless otherwise explicitly agreed between a seller and a buyer, or stated in the license purchased, legal title to a purchased item transfers to the buyer upon physical delivery of the item to the buyer from the seller. Accordingly, unless a Buyer and Seller agree otherwise, legal ownership to any item of content purchased from this site passes to the Buyer upon the physical delivery of such item of Content from the Seller to the Buyer for use in their individual educational capacity.
That purchase and legal ownership by the buyer does not provide or entitle the buyer a means to copy, redistribute, publish or in any way disburse that item between friends, colleagues or to giveaway or onsell by any means.
CANCELLATION
YOU may cancel your store owner membership at any time, however the balance of the yearly store owner fee will not be refunded, ie: this is a non refundable yearly fee.
PRIVACY POLICY
a- WE collect data by means of online transactions by way of:
(i) non identifiable information like cookies, browsers, ISPs, This data allows us to know where visitors travel around our site.
(ii)Identifiable information like – name, address, email, phone, that is provided by YOU.
(iii) IP address- WE collect IP address data as a means of tracking, ie where users go on the site etc. This is intended as a non identifiable information source however YOU should note in circumstances where WE feel it is warranted ie: questions of legality or security arise, this information will be provided as required by law to enforcement agencies.
(iv) If WE note use of proxies, those accounts or use of this service to YOU will be suspended without further notice or restitution.
(v)All electronic purchases from this site are encrypted with tracking to ensure piracy and illegal content sharing is avoided. If any inappropriate activity is detected that item will no longer be accessible to the BUYER.
If by chance something has occurred in error YOU may contact us to clarify.
b- WE store that (ii)Identifiable information as a means of communication to YOU about products, updates, promotions, services and sales.
c- WE make contact with YOU via email.
c(i) – YOU may unsubscribe from regular newsletters at any time.
c(ii)- if YOU are an active member, YOU must provide us with an electronic means of communication.
d- Each individual store will have payment details if YOU purchase from that store to allow for order fulfillment. As required by marketplace service store owners are not permitted to make contact with BUYERS individually unless BUYERS expressly request in writing specifically via individual store contact using the “ASK” tab to do so.
e- (apart from order fulfillment) WE do not provide your data to any other third party for any reason except as required by law if that data is involved in illegal or inappropriate activity as further defined in this agreement.
f- Your personal information access – YOU can update your own information at anytime or request your data to be removed or altered if YOU are unable to do so.
g- External links -The site may contain links to third party sites and services, WE do not endorse nor have any control over such sites nor their products or services. Any reliance on the content or services of such external sites is done at your own risk and YOU assume all responsibility for any issues relating to the use of any external links.
BUYER INFORMATION
Sellers use of Buyer Information:
Unless otherwise authorised specifically in written agreement by 4 Ballroom Co-op marketplace services, Sellers agree to cause themselves, their affiliates, agents, employees and contractors not to – use or disclose to any third party, any order information or other data or information regarding Buyers or any other users of the Service, which is obtained through the Service or disclosed to Sellers by 4 Ballroom Co-op marketplace services or associates in connection with a transaction made via the Service, for any purpose except as necessary to complete transactions made through the Service ie: order fulfilment and otherwise fulfil their obligations under this Agreement (including, without limitation, for purposes of solicitation, advertising, direct marketing, harassment, invasion of privacy, or any other objectionable conduct).
COPYRIGHT
While it is not OUR role to be enforcer or police content, WE will certainly take action in relation to reports:
1- If YOU believe an item offered for sale has infringed YOUR or another persons copyright – contact US immediately here providing details to allow US to investigate.
2- It is OUR policy to disable access to or remove material that WE believe in good faith to be infringing on a copyrighted work.
3- It is OUR policy to disable and/or terminate the accounts of users who WE believe in good faith are repeatedly infringing copyrighted works.
4- It is OUR policy to report those people who WE believe in good faith are repeat infringers to the reported originators of that item and the relevant authorities.
ENTIRE AGREEMENT
The combination of specific seller obligations as updated in your admin panel along with general Terms of Use, Privacy and Copyright policies forms the agreement between you and us and governs your use of this service.
AMENDMENTS
4 Ballroom Co-op marketplace services may change or amend these Terms. If WE make material changes, WE will notify YOU, either through the user interface, in an email notification, or through other reasonable means. YOUR use of the Service after the date such change(s) become effective will constitute consent to the changed terms. If YOU do not agree to the changes, YOU must immediately stop using the Service. Otherwise the new terms will apply to YOU.
